Primary Focus & Experience

Michael has experienced a broad range of transactional and contentious practice areas, including Aviation Finance; Projects, Energy and Infrastructure; Commercial Outsourcing & Technology; and Litigation & Arbitration. Michael has experience in complex commercial disputes in the English Courts and financial regulatory investigations.

• Outsourcing & technology: Acting for several companies in relation to outsourcing disputes arising out of master services agreements. In particular, representing a UK energy company (as claimant) in a long-running dispute concerning claims of misrepresentation and breach of contract against the systems integrator. This involved managing the contractual termination process, pre-action correspondence, preparing statements of case, leading a significant 12-month disclosure exercise and participating in various interlocutory hearings.
• Banking & finance: Representing a large European bank in its defence of claims brought in the English High Court (Commercial Court) for tortious conspiracy arising out of a takeover of a foreign bank. Advising an emerging markets fund in relation to the enforcement of a promissory note in the English Court.
• Aviation & insurance: Acting for an aviation leasing company in the English High Court (Commercial Court) in respect of recovery of rent arrears and successfully obtaining an injunction for specific performance against the airline lessee. Advising a satellite operator in relation to pre-action claims under certain in-orbit insurance policies.
• Arbitration enforcement: Acting for a state in resisting an ICSID Award in the High Court (Commercial Court).
• Investigations: Acting for a European bank in relation to a competition-related investigation led by the European Commission. Advising individuals in relation to FCA investigations relating to adequacy of systems and controls.
• Litigation funding: Advising on the structuring of litigation funding arrangements and negotiating litigation funding agreements.
