Milbank LLP International Arbitration partner Viren Mascarenhas will speak at Asset Recovery Asia on Monday, November 4 in Thailand. He will be a participant on the “Suing States: An Update on Asset Recovery Against Sovereign Defendants” panel.
The panel will cover key recent updates in the law, and strategies for dealing with recalcitrant sovereign defendants: from state immunity and how courts deal with allegations of fraud in the underlying arbitration, to practical questions such as which asset classes to target and where.
Mr. Mascarenhas specializes in investor-state, commercial, and construction arbitration as well as US litigation relating to the enforcement of awards and judgments. He has written extensively about enforcing awards against foreign sovereigns in US courts, including addressing recent DC Circuit Court decisions on exceptions to sovereign immunity, the use of 28 U.S.C. Section 1782 in US courts to obtain discovery aid of worldwide enforcement and collection proceedings against foreign sovereigns, and discovery and execution tools available in US civil procedure to enforce arbitral awards against foreign sovereigns that have been confirmed as judgments by US courts.
