Robert Hora and Atara Miller, partners in Milbank, Tweed, Hadley & McCloy LLP’s Litigation & Arbitration Group, have been recognized in the 2017 edition of Benchmark Litigation’s Under 40 Hot List, which honors the achievements of those deemed the most promising emerging talent in their respective litigation communities by peers and clients.
Mr. Hora’s practice focuses on litigation of complex commercial matters involving mutual funds, securities, commodities, and corporate governance. In recent years, Mr. Hora has had a leading role in some of the most significant cases in the mutual fund industry. He recently prevailed in two high-profile trials on behalf of mutual fund investment advisers. Those cases, which alleged the advisers charged excessive management fees to a series of mutual funds, involved close to $1 billion in alleged damages. The trials represented not only complete victories on behalf of Milbank’s clients, AXA Equitable and Hartford Investment Financial Services, but also set important precedent for the entire mutual fund industry, which has faced a wave of such suits. Mr. Hora also recently obtained dismissal with prejudice on the pleadings of an excessive-fee action against Prospect Capital Management. Mr. Hora currently represents Rabobank in multi-district class action litigation bought under the Commodity Exchange Act concerning alleged manipulation of the London Interbank Offered Rate (LIBOR) and other interest rate benchmarks.
Ms. Miller focuses on federal and state court litigation of complex commercial matters and bankruptcy-related litigation. She regularly represents financial institutions, corporations, and individuals in class actions, securities and breach of fiduciary duty actions. Her recent achievements include successfully challenging the Department of Justice’s interpretation of Broadcast Music, Inc.’s antitrust Consent Decree in a case that impacts more than 750,000 songwriters, composers and music publishers in the more than $2 billion music performing rights industry. Additionally, in helping Puerto Rico’s efforts to reach consensual resolutions with its creditors, Ms. Miller won an important decision from the US Court of Appeals for the First Circuit, allowing negotiations to move forward without the distraction of creditor litigation, and vindicating important principles concerning the application of the Bankruptcy Code’s automatic stay. She currently represents Ambac Assurance Corp. in federal litigation against the Governor of Puerto Rico and other Commonwealth officials to enjoin the diversion of monies pledged to bondholders in violation of the US Constitution. Ms. Miller was also recognized on the Under 40 Hot List in 2016.
