Timothy Fitzpatrick, a member of the Global Project, Energy and Infrastructure Finance Group, is special counsel in the New York office of Milbank LLP.

Primary Focus & Experience
Mr. Fitzpatrick focuses his practice on project finance, project development and limited recourse financings in the energy and infrastructure sectors.
Mr. Fitzpatrick has a particular focus on digital infrastructure, including transactions involving data centers, telecom towers and fiber networks and other related infrastructure. He represents both lenders and borrowers on a broad range of transactions throughout the digital infrastructure lifecycle and has advised on financings involving each of the major hyperscalers. Mr. Fitzpatrick is also focused on the intersection of electric capacity and generation and the increased demand for power in the datacenter market, routinely advising clients in connection with innovative solutions to meet the rapidly changing demand curve.

- The Lenders in connection with CyrusOne’s nearly $8bn borrowing base facility;
- Switch in connection with nearly $10bn of data center financings, including project financings, corporate revolvers and borrowing base facilities;
- The Lenders in connection with a $1bn project financing of a hyperscale datacenter outside Atlanta;
- The Arrangers in connection with refinancing and borrowing base facility for a leading tower developer;
- Rowan in connection with a nearly $1bn project financing of a hyperscale datacenter in Maryland;
- The Arrangers in connection with a warehouse construction financing for a leading FttP Sponsor constructing greenfield open access networks to service fiber-to-the-home customers, small-and-medium-sized business customers and wholesale ISP customers throughout Texas, the Southwest and California;
- The Arrangers in connection with the refinancing of existing debt and financing of growth capex for a leading fiber optic developer servicing enterprise and carrier customers throughout the Northeast and mid-Atlantic regions;
- The Arrangers in connection with construction financing for a leading fiber optic network developer with network routes located throughout the United States; and
- The Lenders in connection with a revolving credit facility that will finance the buildout of fiber-optic infrastructure by Intermountain Infrastructure Group, LLC, in Washington, USA and California, USA.
Recognition & Accomplishments
Mr. Fitzpatrick is fluent in Spanish and proficient in Portuguese. He received History and Latin American Studies degrees from Boston College, a Masters of Latin American Studies from the Georgetown School of Foreign Service, and a law degree from the Georgetown University Law Center.
